A civil relationship does not immunise criminal conduct. Equally, not every breach, dispute or civil wrong is a crime. The question is what act was reported and what test was applied.

What to record

Contemporaneous, precise and yours to keep.

Recording laws and organisational rules can vary. A written note is not the same as making a covert audio recording. Check the applicable rules or obtain advice before recording calls or people.

  • Date, time, place and method of contact
  • Name, number, role, organisation and team, if provided
  • Exact words where possible, clearly separated from your recollection or opinion
  • Every incident, complaint, case and document reference
  • The decision or refusal, the reasons given and who made it
  • Evidence offered, what was accepted, and what was declined
  • Witnesses or other people present
  • Promised action, deadline and next contact
  • Original documents and files, including metadata where available
  • What you asked for and which part was not answered

Phrases that mean: slow down

Stock phrases can signal that a decision, limit or refusal needs to be identified precisely.

A stock phrase is a prompt to ask for precision. It is not proof of bad faith, illegality or a predetermined outcome.

“We know this may not be what you want to hear.”

Ask: What decision has been made, by whom, under what rule, on what facts, and how can it be reviewed?

Ask: Which reported act is civil, which possible offences were considered, and does this mean no crime, no current evidence, or no further investigation?

Let Justice Be Done grew from one layperson's frustration with explanations that appeared to lose the point: classifications without intelligible reasons, records that did not match what had been supplied, and complaint procedures that seemed to discuss process rather than answer the question. Personal experience is labelled as experience. Official claims are checked against official sources. Unknown remains unknown.
